TERMS AND CONDITIONS


1. Regulations for Lodge op de Berg. The property "Lodge op de Berg," located at Stukkenstraat 10, 3960 Bree (Belgium), is managed by the company "Op de Berg" (VAT no. BE0842.154.097). These regulations (reservation terms and code of conduct) must be respected by all guests and visitors on the property. By paying the invoice, the renter acknowledges and accepts the reservation terms and code of conduct.

2. Reservation Terms
2.1. Reservation
Include:
• Accommodation in the lodge
• Costs for the number of persons the lodge is designed for
• Water and electricity costs
• Tourist tax
• Final cleaning
• Administrative fees
• VAT (as stated on the invoice)

Exclude:
• Hot tub
• Bed and bath linens

2.2. Lodge Capacity. The number of persons per lodge (as indicated on the website) corresponds to the maximum allowable occupancy, taking available facilities into account. For safety and insurance purposes, this number may not be exceeded. The person booking and paying for the reservation is responsible for adhering to the code of conduct and settling the invoices.

2.3. Visitors. Visitors are not permitted on the property unless explicitly authorized in advance. Exceptions must be requested in writing by the renter well in advance and approved in writing by Lodge op de Berg. If visitors are allowed, a written list (first name, last name, age, and reason for the visit) must be provided in advance.

2.4. Pets. Bringing pets to the property is not permitted.

2.5. Changes or Cancellations. Cancellations must always be made in writing via registered letter or email. The following terms apply to cancellations (only for direct bookings with Lodge op de Berg:
• Cancellation up to 6 months before arrival: Free of charge
• Between 6 and 3 months before arrival: 40% of the booking will be retained
• Between 3 and 2 months before arrival: 50% of the booking will be retained
• Between 2 and 1 month before arrival: 60% of the booking will be retained
• Within 30 days before arrival: 100% of the booking will be retained

For cancellations by Lodge op de Berg (in advance). Lodge op de Berg reserves the right to cancel stays for safety reasons (e.g., severe weather warnings). If this occurs:
• The stay may be rescheduled within the next 12 months, or
• The full payment will be refunded.

For cancellations during the stay. If you refuse or fail to enter the property upon arrival for any reason, no refund will be granted.

2.6. Safety. Guests and visitors are responsible for their own safety, particularly for children. Use of the lodges is at your own risk under certain conditions (e.g., pregnancy, physical limitations).

2.7. Liability. Lodge op de Berg is not liable for theft, loss, or damages during or resulting from your stay. Guests are jointly liable for any loss or damage caused by their stay.

2.8. Deposit. The deposit will be refunded within 14 days if no damages, exceptional cleaning, or losses are reported. If damages occur, Lodge op de Berg reserves the right to withhold part or all of the deposit.

2.9. Disputes. All complaints must be submitted by registered mail within 15 days after your stay. Disputes will be handled by the competent courts in the judicial district of Tongeren under Belgian law.

3. Code of Conduct
3.1. Care for the Domain
• Treat buildings, furniture, and vegetation with care.
• Conserve water and energy.
• Dispose of waste properly.
3.2. Accessibility. Cars must be parked in designated areas.
3.3. Final cleaning. Lodges must be left clean and orderly. Unsorted waste or excessive cleaning needs will incur additional charges.
3.4. Fire. Fires are only permitted in designated areas and under specific safety conditions.
3.5. Hot Tub. The wood-fired hot tub is not included in the standard booking. A session costs €100 and must be reserved at least 24 hours in advance. Safety regulations apply, and use is at your own risk. The hot tub is not included as a standard feature in the booking of our lodges. The wood-fired hot tub can be booked for €100 per daily session. A daily session starts at 5:00 PM or later and ends no later than 11:00 PM. Reservations must be made at least 24 hours in advance to ensure that the hot tub can be properly heated and cleaned by Lodge op de Berg. The hot tub is preheated using firewood and/or the lodge's water heater. This means that during the heating process and for a few hours afterward, hot water availability in the lodge, such as for showers, may be limited or unavailable.
During periods of extreme drought, frost, or strong winds (from Beaufort scale 4 or higher), the hot tub will not be rented due to fire and/or frost risks, as well as potential physical and/or material damage.
Guests using the hot tub must adhere to specific safety and usage guidelines as described in the terms and conditions below. Parents are strongly advised to supervise children at all times, and users are reminded to handle open flames and hot surfaces with care. Use of the hot tub is at the guest’s own risk, and by booking, guests agree to the terms and conditions outlined below. These terms cover topics such as reservation and rental periods, usage rules, renter responsibilities, safety measures, and liability. Adhering strictly to these terms ensures the safety of all users and maintains the high quality of the facility.
1. Applicability
1.1 These terms and conditions apply to all legal relationships, regardless of their designation, between Lodge op de Berg and the renter.
2. Rental Period
2.1 A daily session starts at 5:00 PM or later and ends no later than 11:00 PM.
2.2 During extreme drought, frost, or strong winds (from Beaufort scale 4 or higher), the hot tub will not be rented due to fire and/or frost risks, as well as potential physical and/or material damage.
3. Renter Obligations
3.1 The renter must reserve the hot tub at least 24 hours in advance.
3.2 The renter must handle and use the hot tub carefully and in accordance with the operating instructions provided at the start of the rental. No alterations may be made to the hot tub.
3.3 The renter must reject any claims by third parties on the hot tub and notify Lodge op de Berg immediately of such claims.
3.4 The renter declares to have liability insurance.
4. Payment
4.1 Unless explicitly agreed otherwise, payment must be made before use.
4.2 If the renter fails to pay within the specified period, they are in default without further notice of default.
5. Security Deposit
5.1 The security deposit is paid in advance via bank transfer. After the rental period, the materials will be inspected, and the deposit will be refunded if everything is in order.
5.2 If damages are found, they will be deducted from the deposit. If the deposit does not cover the costs, Lodge op de Berg reserves the right to issue an invoice for the repairs.
6. Renter Usage Conditions
6.1 All rented materials must be used carefully. Any instructions or usage conditions provided must be strictly followed. The renter is fully responsible for the rented materials during the rental period.
6.2 Damages to the rented materials occurring during the rental period must be reported immediately to Lodge op de Berg.
6.3 The rental period starts as specified in the rental agreement and ends only after all materials are returned and inspected by the lessor.
6.4 It is prohibited to make or authorize changes or repairs without the express consent of Lodge op de Berg.
6.5 Only the provided firewood may be used. Burning inferior wood or materials is prohibited. The fire may only be started with the supplied fire starters.
6.6 The renter must comply with all safety instructions. Any damage caused by accidents or misuse is the renter's responsibility.
6.7 The use of the hot tub is at the renter’s own risk. Health conditions must be assessed by a doctor beforehand.
6.8 Children must be supervised by an adult at all times.
7. Heating the Hot Tub
7.1 Lodge op de Berg will heat the hot tub to a maximum of 38°C using firewood and/or the lodge’s water heater. During this time and for a few hours afterward, there may be limited or no hot water in the lodge.
7.2 The heater must not be lit if the water level does not cover the top water outlet of the heater, as this can cause cracking.
7.3 Do not let the water temperature exceed 40°C, as this can cause burns and damage the hot tub and heater. If this occurs, immediately add cold water.
7.4 Once the water temperature is between 30°C and 35°C, the fire should be allowed to die out. Adding more wood may cause the temperature to rise excessively.
7.5 The heater will continue to heat the water gradually as long as embers remain. Stir the water regularly to distribute the temperature evenly.
8. Personal Safety
8.1 Avoid touching or coming close to the heater while it is hot.
8.2 Never leave a filled hot tub unattended. If you must leave, extinguish the fire and secure the tub with a hard cover, or drain it entirely.
8.3 Children must never be left alone near or in the hot tub.
8.4 Enter and exit the hot tub slowly, as the surface may be slippery.
8.5 Do not jump into the hot tub. This may cause injury or damage.
9. Liability
9.1 The renter is liable for all damages resulting from misuse, damage, loss, or theft of the rented materials during the rental period. Normal wear and tear is excluded.
9.2 If the renter breaches these terms, any costs incurred by Lodge op de Berg, including legal fees, will be charged to the renter.
10. Insurance
10.1 The renter must inform their insurance provider and initiate claims procedures immediately in the event of damage caused by irresponsible use or accidents.
11. Termination
11.1 Lodge op de Berg may terminate this agreement immediately if the renter fails to meet any obligations under this agreement.
12. Retention of Ownership
12.1 The rented materials remain the property of Lodge op de Berg at all times.
12.2 The renter may not pledge or sublet the rented materials.

3.6. Check-in and Check-out. Details about check-in and check-out procedures are provided upon booking.
